GENERAL TERMS AND CONDITIONS OF SALE
The offer and sale of products on our website www.lerayonfrais.fr are governed by these General Terms and Conditions of Sale.
Le Rayon Frais sells products on www.lerayonfrais.fr and conducts its own online business exclusively for the end user.
The term "end consumer" refers to any natural person who operates for purposes unrelated to any business or professional activity that may be carried out.
The fresh produce department reserves the right to refuse orders from any person who is not an "end consumer" or orders that do not comply with its commercial policy as defined herein.
The general terms and conditions of sale may be modified, particularly in light of any regulatory changes. The new general terms and conditions of sale will apply from the date of their publication on lerayonfrais.fr
ACCOUNT
We reserve the right to refuse access, close an account, if you are in violation of applicable laws, these Terms of Use or any other terms, conditions, guidelines or policies of Rayon Frais.
ORDER
When placing their first order, the user must create an online account with their personal details and keep them up to date.
The contract is deemed concluded after validation by Le Rayon Frais of your order and this after receipt, by electronic means, of the order form, once the accuracy of the data relating to the order has been verified.
Before proceeding with the purchase of products by submitting the order form, you are asked to carefully read these General Terms and Conditions of Sale.
Le Rayon Frais reserves the right to cancel and refund any order that contains errors in price display (e.g., free order) or item availability.

VALIDATION
The data recorded by our services when validating your order constitutes proof of all transactions between the fresh produce department and its customers.
The data recorded by the payment system constitutes proof of financial transactions.
AVAILABILITY
Our product offers are subject to availability.
Make sure your contact details are correct: name, address and telephone number.
When placing your order, check item by item that the quantity, color, size and price are correctly taken into account in your order form.
If an item is unavailable after an order has been placed, the Customer will be notified by email. This email will inform the Customer, if applicable, of the item's availability date. The unavailability of one or more items does not affect the rest of the order. If the item is permanently unavailable, or if the Customer does not wish to wait for its availability date, a refund will be issued for the corresponding price within 30 days of the Customer's payment date.
PRICE
Our product prices are listed in euros, inclusive of all taxes but excluding processing and shipping fees. These prices are provided in euros with currency conversion options.
If you are ordering from a country other than mainland France, you are the importer of the product(s) in question.
For all products shipped outside the European Union and French overseas departments and territories (DOM-TOM), the price will be automatically calculated excluding taxes on the invoice. Customs duties, local taxes, import duties, or state taxes may be applicable. These duties and amounts are not the responsibility of lerayonfrais.fr. They are your responsibility and must be paid by you, both in terms of declaration and payment to the relevant authorities and organizations in your country. We advise you to inquire about these matters with your local authorities.
All orders must be paid in Euros.
lerayonfrais.fr reserves the right to change prices at any time, but products will be billed based on the rates in effect at the time the orders are registered, subject to availability.
DELIVERY
The products will be delivered to the delivery address provided during the ordering process. We make every effort to ensure delivery within 10 days. Should any difficulties arise, we will keep you informed.
If you have chosen the "In-store pickup" option, please come to the Bordeaux store, located at 11/15 rue st James 33000 Bordeaux, or to the Biarritz store, located at 15 blvd du Général de Gaulle, with your ID.
The shops are open Monday to Saturday from 10:30am to 7pm.
The opening hours of the Biarritz store may vary depending on the season.
Important: Any order placed on Friday / Saturday / Sunday, with the direct collection option at the store, can only be collected on Monday from 4 PM.
The fresh produce section uses DHL and the postal service, with shipments sent via Colissimo registered mail for France and worldwide.
Delivery charges are calculated automatically as soon as you finalize your shopping cart and appear in the total to pay.
When your parcel is delivered by TNT, it will be presented at the address you provided when placing your order. However, if you are not home or the delivery driver is unable to contact you, your parcel will be delivered to the nearest parcel collection point to the delivery address.
When we send you the package, we will send you its corresponding number by email.
Customs fees and other charges in the country of arrival are the responsibility of the buyer.
In the event of loss or damage to the product during transport, the customer must inform the carrier without delay.
In case of an unusual delay, you will receive an email.
In the event of a delivery delay exceeding 7 days that is not due to force majeure, the Customer is invited to contact customer service. If their request cannot be resolved, they may cancel their order and request a refund of the sums paid by registered letter with acknowledgment of receipt to the following address: Le Rayon Frais, 31/33 rue Saint James, 33000 Bordeaux, France. This right must be exercised no later than 60 business days following the expiry of the initially scheduled delivery date. The contract will be considered terminated upon receipt of the registered letter if the item has not been delivered between the sending and receipt of the letter. The Customer will then be refunded no later than 30 days from the date of receipt of the registered letter by the Company.
PAYMENT
All orders shipped to France and the EU are expressed in Euros inclusive of all taxes, with the VAT rates in force in France.
You may be asked for additional information to secure your payment.

SECURITY
Our site is protected by a security system.
We have adopted the SSL encryption process and have also strengthened all scrambling and encryption processes to protect all sensitive data related to payment methods as effectively as possible.
INTELLECTUAL PROPERTY
All texts, comments, works, illustrations, and images reproduced on the website lerayonfrais.fr are protected by copyright and intellectual property rights worldwide. As such, in accordance with the provisions of the French Intellectual Property Code, only use for private purposes is permitted, subject to any different or more restrictive provisions of the Intellectual Property Code. Any other use constitutes infringement and is punishable under Intellectual Property law unless prior authorization has been obtained from lerayonfrais.
Any reproduction, in whole or in part, of the lerayonfrais.fr catalogue is strictly prohibited. All rights reserved.
APPLICABLE LAW - DISPUTES
This contract is written in French and governed by French law. In the event of any legal dispute, only the French courts shall have jurisdiction.

Lerayonfrais.fr is committed to not disclosing the information you provide to third parties. This information remains confidential. It will only be used by our internal departments to process your order, enhance and personalize communication, and tailor the cultural offerings reserved for our customers.
Consequently, and in accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify, and object to the personal data concerning you. To do so, simply send us your request online (contact@lerayonfrais.fr).
RESPONSIBILITY
The products offered comply with current French legislation. It is your responsibility to check with the local authorities in your country regarding the import or use of the products or services you intend to order.
The photographs and texts used to illustrate the products are not contractual. Consequently, lerayonfrais.fr cannot be held liable for any errors in photographs or text.
Lerayonfrais.fr cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage, unavailability of the product, in the event of force majeure, disruption, flood, fire or strike in particular of postal services and means of transport or communication.
